Simple terms for creating with Peak.

These Terms of Use are an agreement between you and ROAS Solutions LLC, the provider of Peak. By downloading, accessing, purchasing through, or using Peak, you agree to these terms and our Privacy Policy.

If you do not agree, do not use Peak. Additional terms from Apple or a third-party service may also apply to your use of that service.

You must be legally able to enter into this agreement and meet the minimum age required to use online services in your location. If you use Peak for an organization, you represent that you have authority to accept these terms for that organization.

Peak provides AI-assisted conversation and creative tools, including image generation, reference-image editing, video generation, and specialized creation modes. Features, models, limits, credit costs, and availability may change as the service develops.

We may update, add, suspend, or remove features when reasonably needed to improve Peak, address safety or legal concerns, maintain third-party integrations, or protect the service.

AI systems can produce inaccurate, incomplete, unexpected, or offensive results. Outputs may resemble material created for other users and may not be unique. Peak does not guarantee factual accuracy, originality, availability, or fitness for a particular purpose.

You are responsible for deciding whether an output is appropriate for your use and for complying with laws, platform rules, disclosure requirements, and third-party rights.

You retain any rights you have in prompts, reference images, and other content you submit. You represent that you have the rights and permissions needed to submit that content and request the intended processing.

You grant ROAS Solutions LLC a limited, non-exclusive, worldwide license to host, copy, transmit, process, display, and otherwise use your submitted content only as reasonably needed to operate, secure, support, and improve the Peak service and fulfill your requests. This license ends when the content is no longer reasonably needed for those purposes, subject to legal obligations, security records, and provider backups.

You may not use Peak to:

• break the law or facilitate illegal, fraudulent, or harmful acts;
• exploit, endanger, sexualize, or otherwise harm children or any person;
• violate privacy, publicity, intellectual-property, or other rights;
• impersonate others deceptively, create non-consensual intimate content, or misrepresent generated media as authentic where that would be harmful or unlawful;
• distribute malware, probe security, overload the service, bypass limits, or interfere with another user;
• reverse engineer or extract models, source code, or service components except where applicable law expressly permits it; or
• use outputs to make unlawful or solely automated high-impact decisions about another person.

We may investigate suspected abuse and restrict content, requests, or access when reasonably necessary to protect users, providers, Peak, or the public.

Apple billing

In-app purchases are processed by Apple under the terms connected to your Apple Account. Prices, included features, renewal terms, and any trial details are shown before purchase. Auto-renewing subscriptions continue until canceled through your App Store subscription settings.

Credits

Credits are consumable units used for eligible Peak features. The number of credits required may vary by model, quality, or generation type and is shown in the app. Credits have no cash value and may not be sold, transferred, or redeemed outside Peak except where required by law.

Restores, cancellations, and refunds

You can restore eligible purchases in Peak. Cancel subscriptions in your Apple App Store settings. Apple controls payment processing and refund decisions; deleting Peak or deleting your Peak account does not cancel an Apple subscription.

Peak, including its software, interface, branding, design, and service content, is owned by ROAS Solutions LLC or its licensors and is protected by applicable law. These terms give you a limited, revocable, non-transferable right to use Peak for its intended purposes; they do not transfer ownership of Peak to you.

Subject to these terms and applicable law, we do not claim ownership of the outputs generated for you. Laws concerning AI-generated material vary, and no ownership or exclusivity is guaranteed.

Peak relies on services such as Google Firebase, Fal.ai, relevant AI model providers, RevenueCat, and Apple. Their systems, terms, and policies may apply when they process a request or purchase. We are not responsible for third-party services outside our reasonable control.

You may stop using Peak at any time and may delete your account from Settings. We may suspend or terminate access when you materially violate these terms, create risk or harm, fail to pay applicable charges, or when necessary to comply with law or protect the service.

Provisions that by their nature should continue after termination remain in effect, including provisions about ownership, disclaimers, liability, and disputes.

To the fullest extent permitted by law, Peak is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

To the fullest extent permitted by law, ROAS Solutions LLC and its affiliates, officers, employees, and service partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from Peak.

Where liability cannot be excluded, our aggregate liability arising from Peak will not exceed the greater of the amount you paid for Peak during the twelve months before the event giving rise to the claim or USD $100. Applicable consumer law may provide rights that cannot be limited by these terms.

Before filing a formal claim, please contact us and describe the issue so we can try to resolve it. These terms are governed by the laws that apply to ROAS Solutions LLC and your use of Peak, without overriding consumer protections or forum rights that cannot lawfully be waived. A court with lawful jurisdiction may resolve any dispute not resolved informally.

We may update these terms as Peak or applicable requirements change. We will post revised terms here and update the effective date. If a change is material, we may also provide notice in the app or through another appropriate channel. Continuing to use Peak after updated terms take effect means you accept them.
